During the construction stage, ACI can provide a diagnosis and/or contractual monitoring service, focused on conflict prevention or mitigation. Additionally, we offer support in the integral management of contractual claims. 

Diagnosis

The diagnosis carried out by ACI is based on the review of the Client's key management processes and thus identify the areas and processes to be optimized. By way of illustration this can be summarized, but is not limited to:

Contractual Accompaniment

Focused on prevention and mitigation, we offer  a contractual accompaniment which will be designed and adjusted to the particularities of each project and the needs of each Client. As a basis, this service could include the following:

  • Review, monitoring and evaluation of the contractually binding documentation that is produced during construction. 

 

  • Issuance of reports, including, but not limited to: 

 

- ​Review of compliance with the scope of the contract 

- Objective analysis of the schedule deviations, costs and forecast estimation 

- Corrective action and mitigation plans

- Integrated control of changes and deviations 

- Analysis of additional and extraordinary works 

- Assessment of risks and their impacts 

- Unforeseeable conditions

 

  • Specific technical analysis of construction processes and quality, case by case. Service focused on developers, project owners and financial entities. 

Claim Management 

In cases in which the conflict or divergences between the parties are already installed, ACI offers all its experience to support and strengthen the position of its clients in complex claims. Our work includes: 

 

  • Analysis and conception of claims to be issued for additional costs and time

  • Verification and budgeting of claim requests from subcontractors, in terms of their contractual rights as well as their technical and economic reasonability

  • Support for the elaboration of balance sheets of economies and excesses due to changes in the contractual scope (Quantum) 

  • Strategic planning and support in negotiations
